What is At-will Employment?

At-will employment is a type of employment relationship in which either the employer or the employee may terminate the employment at any time, for any reason (with or without cause), and without advance notice.

Exceptions of At-will Employment

It's important to note that there are some exceptions to at-will employment, such as:

  • Illegal discrimination: At-will employment does not allow an employer to terminate an employee based on their race, gender, age, religion, national origin, sexual orientation, or any other protected characteristic. 
  • Public policy exception: Some states have laws that prohibit employers from terminating employees for certain reasons that are against public policy. For example, an employer cannot terminate an employee for reporting illegal or unethical behavior in the workplace.
  • Collective bargaining agreements: If an employee is covered by a collective bargaining agreement, the terms of the agreement may limit the employer's ability to terminate the employee. For example, if the agreement requires that the employer must follow a specific disciplinary process before terminating an employee, the employer must do so.
  • Compliance with other laws: Employers cannot terminate an employee for reasons that would violate other laws, such as whistleblower protection laws or the Family Medical Leave Act. For example, an employer cannot terminate an employee for taking protected medical leave.

  • Your employment with us is at-will, and may be terminated by you or us at any time, for any reason (with or without cause), and without advance notice.
  • This policy supersedes any and all prior agreements, understandings, or representations, whether oral or written, regarding the terms and conditions of your employment with us.
  • This policy may be amended or revised by us at any time, and any such amendment or revision will be effective upon notice to you.
  • Nothing in this policy shall be construed as creating a contract of employment, or as limiting our ability to terminate your employment at-will.
  • Your continued employment with us shall constitute your acceptance of this policy and any amendments or revisions thereto.
